Senior Congress leader and leader of opposition in Lok Sabha Rahul Gandhi, is currently on a 'Voter Rights Yatra' in Bihar. In this connection, he reached Darbhanga, but political decorum was broken in his rally here. During the rally, Rahul Gandhi first targeted Prime Minister Narendra Modi and used abusive language for him. Meanwhile, a person named Rizvi alias Raja broke all decorum and publicly abused PM Modi's mother on the mic. The video of which is going viral on social media.

All citizens are equal in the eyes of the law, but…
The Indian Constitution says that all citizens are equal before justice. Everyone has the right to express their views, but if someone is hurt by someone's words, then that person can file a defamation case against that person. Whereas in the case of the Prime Minister, it comes under the category of a more serious crime. The PM does not file a case himself, but the judicial system or the administration can take action on his behalf, because he represents not just an individual but the entire country.
When can action be taken?
- If anyone uses abusive language against the PM on a public platform or on social media.
- If any post, cartoon or content hurts their dignity.
- If someone's statement poses a risk of spreading hatred or violence in society.
What sections can be applied?
Section 356- Defamation
It is a crime to malign someone's image by speaking, writing, gesturing or through any media. For this, the person can be jailed for two years, fined or both.
Section 352- Abuse or indecent language
Abusing the PM in a public place or doing indecent acts against him is also a serious crime. In this case, the PM has been abused publicly on stage. In such a case, the punishment can be three months imprisonment, a fine, or both. If the case is related to obscenity, then the sections can be increased.
If someone directly abuses the Prime Minister, not only Section 352, but also Section 356 (defamation) and other sections are also added.
